1. General
1.1 This Privacy Statement describes how Immaginare processes the personal data of its Data Subjects, for example (potential) customers, applicants, business partners, suppliers, intermediaries, etc.

2 Personal data
2.1 Personal data concerns information about an identified or identifiable natural person. Immaginare may process the following data from Data Subjects, for example:
- Name;
- E-mail address;
- Phone number;
- Data relating to the Data Subject's device, such as an IP address;
- Communication preferences;
Information obtained via cookies about the surfing behavior of the Data Subject
Etc.
2.2 Immaginare collects personal data from a Data Subject in the following manner(s), for example:
- when the relevant Data Subject has provided this personal data to Immaginare via the Website;
- by contacting us with a request for information about Immaginare's services or products;
- place an order with Immaginare; or
- because these are generated based on the Data Subject's use of the services or Website of Immaginare, including via cookies; or
- From third parties, such as recruitment agencies in the context of recruitment and selection.
2.3 If the Data Subject is obliged to provide certain information, the Data Subject will be informed of the possible consequences if this is not provided.

3. Purposes and bases for processing personal data
3.1 Immaginare processes the personal data of a Data Subject on the basis of a legal basis based on the General Data Protection Regulation:
a. Consent
b. Execution of an agreement with the Data Subject
c. Complying with a legal obligation
d. Fulfillment of a task of general interest
e. Legitimate interest of Immaginare or a third party
3.2 Immaginare processes certain personal data to promote our legitimate interests. Immaginare's legitimate interests include: marketing, advertising, research of its own products or services, IT management and security, sharing with Immaginare affiliated parties, etc.
3.3 Immaginare processes personal data for the following purposes, based on the principles stated:
Goal
- Offering products or services or maintaining a supplier relationship, including offering customer service or technical support and processing requests relating to the products or services. Basis for execution of the agreement, legitimate interest.
- Improvement of the products or services offered, including by analyzing their use. Basis for execution of the agreement, legitimate interest.
- Recruitment of personnel, processing applications received via our Website or otherwise, screening of the applicant where necessary. Basis for legitimate interest.
- Entering into and maintaining a customer relationship with the Data Subject, for example for sending informative messages about products or services or responding to questions and requests from the Data Subject. Basis for execution of the agreement, legitimate interest.
- Handling, management and invoicing of orders. Basis for execution of the agreement, legitimate interest.
- Guaranteeing the security (of IT systems), including the data collected through the use of access passes and sound and image data such as CCTV or images. Basis for legitimate interest
Sending the Immaginare newsletter. Basis for legitimate interest in consent.
- Providing targeted advertisements based on the interests of the Data Subject, using cookies and similar technologies to collect relevant information about the Data Subject. Basis for legitimate interest in consent.

5.Parties that have access to personal data
5.1 Immaginare will in principle not provide personal data to other parties. But this is possible if:
a) the personal data are provided to processors engaged by Immaginare with whom a processing agreement has been concluded or to independent controllers, for example IT, hosting, HR or other service providers, external advisors, accountants or lawyers; or
b) Immaginare is obliged to pass on personal data to competent authorities, for example supervisors or other public authorities, on the basis of a legal obligation; or
c) the personal data are provided to a company that belongs to the Immaginare group or another department within the Immaginare company.
5.2 Providing personal data to the above-mentioned parties will only take place for the purposes stated in this privacy statement, and to the extent that this is permitted under this privacy statement and applicable laws and regulations, or if Immaginare has a legal obligation to provide personal data to a competent authority. Parties to whom personal data are provided are themselves responsible for compliance with privacy legislation. Immaginare is neither responsible nor liable for the processing of your personal data by these parties.

6. Cookies or similar technologies
6.1 Immaginare uses so-called 'cookies'. With these cookies, Immaginare automatically collects certain data about the history of activities of the Data Subject on the Website and third-party apps, in accordance with the preferences specified by the Data Subject. For example, personal data of the Data Subject may be collected while the Data Subject uses the Website or apps or if they are running in the background on the Data Subject's device. This data can be combined by Immaginare with other data about the Data Subject's device, such as an IP address. 7. Profiling
7.1 Immaginare uses profiling. This means that certain personal aspects of Data Subjects are evaluated on the basis of personal data, in particular personal preferences. Based on profiling, Immaginare can make decisions that may have legal consequences for a Data Subject.

7. Rights of Data Subjects
7.1 The Data Subject has the right to inspect, rectify and delete his or her personal data, in accordance with the provisions of the General Data Protection Regulation. The data subject also has the right to object to the processing of his or her personal data.
7.2 The data subject may request Immaginare to restrict processing and data portability. The latter means that the Data Subject has the right to receive the personal data that the Controller has about him or her in a structured, commonly used and machine-readable form and, if necessary, to have it passed on by Immaginare to another Controller.
7.3 If the Data Subject has given consent to the processing of his personal data, the Data Subject has the right to withdraw this consent at any time.
7.4 If the Data Subject wishes to exercise one of these rights, or if the Data Subject has any questions about this Privacy Statement, the Data Subject can contact Immaginare at e-mail address + postal address, or contact the Data Protection Officer via contact details.
7.5 Those involved can unsubscribe from the newsletter by sending an email to info@immaginare.nl.
7.6 Data subjects have the right to file a complaint with the Dutch Data Protection Authority, which can be done via: www.autoriteitpersoonsgegevens.nl/ .

9. Changes to this Privacy Statement
9.1 Immaginare reserves the right to amend this Privacy Statement. Immaginare announces this change in accordance with the law. Any adjustment will be announced on this page and a clear notification will follow on the Website and by e-mail in the event of a material change to the Privacy Statement. Immaginare therefore advises the Data Subject to regularly check this page to see whether any adjustments have been made.
9.2 If the Data Subject continues to use the Immaginare website once the changes take effect, this means that the Data Subject accepts the changes. If the Data Subject does not agree to these changes, he must discontinue use of the website.
